The Missouri Court of Appeals has officially dismissed a lawsuit against a local company because they don’t have the authority due to pending issues. According to reports, the 28 million dollar lawsuit against Copeland Scroll Compressors now owned by Emerson Climate Technologies was first filed by 56 year old Philip Berger in 2013 and he won the case. The issue is due to filing times for the case’s appeal between the attorneys and the judge has sent the case back to Laclede County. The dismissal order indicated that Berger had sought to dismiss Laura Rumfelt, an employee at the plant also named in the lawsuit, but it was objected by her attorney who worried about future lawsuits. A motion was never made to dismiss her without prejudice leading to the issues.
