The U.S. District Court of Appeals for the D.C. Circuit has dismissed the Environmental Protection Agency’s rule regarding misfueling mitigation plans for the sale of E15 gasoline that contains ethanol. Several area boat manufactures were looking for some kind of ruling to come down as they claim the corn based fuel actually damages outboard motors. The court claims that the opposition to E15 quote “Failed to establish Article 3 standing because they could not show members has suffered or are with suffering an injury due to the fuel that would be traceable to this misfueling regulation and redressable by a favorable decision.” Groups backing the opposition say “It’s not over yet” and that this is only a “temporary road block” in the process.
