The conviction of a Miller County woman in connection to the death of her newborn baby has been overturned by an appellate court. 43-year old Emily Usnick had been convicted of involuntary manslaughter after she gave birth to the child into a toilet in 2009. The child was then allegedly wrapped in a plastic bag and hidden in a container in the trunk of a car. She was sentenced to five years in prison. On Tuesday that verdict was overturned by the Court of Appeals for the Western District of Missouri. The court ruled that the prosecution failed to prove that her actions caused the death of the child. Prosecutor Ben Winfrey says his office will review the ruling before determining what steps they’ll take next.
