A judge in the case of a lawsuit brought against the city of Eldon has sided with the city. According to reports, Judge Ralph Jaynes dismissed a lawsuit brought up in 2010 against the city over water and sewer billing ordinances because the plaintiffs failed to file a proper response to the city’s motion in a summery judgment filed on June 2nd. The lawsuit was filed by a group of 17 area landlords who protested the city’s meter system ordinances following a restructuring of the city’s system was charging a fee per unit in addition to actual usage. The plaintiffs are planning to file a notice of appeal by September 8th, which falls within the required 10 days to file.
