Dismissing the case against an admitted child rapist was the right ruling, according to the Court of Appeals. Aaron Fisher, formerly of Brumley, was being charged for First Degree Statutory Sodomy for raping his infant daughter when his attorneys filed a motion to dismiss based on a violation of his right to a speedy trial. Judge Patricia Joyce agreed with the attorney and dismissed his case in 2014. Miller County Prosecuting Attorney Ben Winfrey had filed an appeal to the Missouri Court of Appeals Western District, but they agreed with Judge Joyce. Fisher was arrested in Ohio earlier this week on a $100,000 bond for an assault charge filed by Winfrey for the same incident.
