Prosecutors have less than a week to comply with a court order or decide to waive the death penalty in a Miller County murder case. John Joe Powell is charged with first-degree murder and armed criminal action. He allegedly beat 55-year old Mark Johnson and dragged him behind a vehicle in a dispute at Iguana Campground in September of 2017. Johnson later died from his injuries. Prosecutor Ben Winfrey filed a notice to seek the death penalty in July of last year. So far, the prosecution has not disclosed their death penalty phase witnesses or evidence. According to a recent court ruling, that needs to happen by the end of the month or they’ll have to waive the death penalty.
