Lieutenant Governor Peter Kinder filed suit last week in federal court in his official and personal capacity. Kinder is challenging the constitutionality and fairness of the federal health care legislation.
The Jefferson City News Tribune says Attorney General Chris Koster asked yesterday to have part of that suit dismissed, Koster saying that Kinder should not be allowed to sue in his official capacity as Lieutenant Governor.
Kinder’s lawsuit says the federal health care law will harm Missouri’s seniors. A spokesperson for Kinder has said that as Lieutenant Governor, Kinder has a statutory duty to defend and advocate for Missouri’s seniors.
