Lake Ozark Business Files Injunction Lawsuit Against TCLA

A lawsuit filed in the 26th circuit court appears to be targeting the Tri-Country Lodging association.

According to court documents, Gail Griswold who owns Shawnee Bluff Winery and Inn in Lake Ozark, filed the Petition for Declaratory Judgement and Injunctive Relief in April against the Board Member Elections conducted by the Miller County Business District who collect lodging taxes in the county.

In the 27 years since the existence of the Lodging Associating, there has been no record of any election being held for the Board members by the district, which is an electing authority as defined by the county clerk.

As of today, all board elections have been held at a private office of the non-governmental agency TCLA which is located in Osage Beach and remains outside of Miller County.

Griswold indicates to the court that a lawful election for the district is needed and until such election occurs, the business District should keep from distributing all tax collections to the non-elected board.
