A lawsuit challenging the validity of a proposed statewide fuel tax increase will go before a judge a week from Friday. State Representative Mike Moon and activist Ron Calzone filed the suit alleging that the issue was passed unconstitutionally in the legislature and should not appear on the ballot in November. According to the lawsuit, the bill was changed from its original purpose and included more than one unconnected subject, both of which the plaintiffs say violates Missouri’s constitution. Formal arguments will be heard on August 3rd. Both sides are expected to appeal if they lose. Issues appearing on the ballot in November must be certified by September 11th.
