A suspect being charged in Miller County with failing to comply with Halloween restrictions for sex offenders is scheduled to be returned from the department of corrections for a preliminary hearing in March. 41-year-old Robert Hertel is currently being held in DOC on an unrelated possession charge. Hertel was among several in the lake area to be charged with the class-A misdemeanor for violating Halloween restrictions. In Hertel’s case, he was not home between the hours of 5pm-10pm when compliance checks were conducted and he did not have a sign posted on his door saying there was no trick or treating or candy being handed out. If convicted on the charge, Hertel could be sentenced to up to an additional year in custody. His preliminary hearing in Miller County is set for March 23rd.
