The incident happened at just before 7 o’clock on Missouri 52, three quarters of a mile west of St. Elizabeth. 35-year old Julie Laux of Westphalia was driving her 2005 Chevrolet east on the road when she went off the south side of the road. Laux overcorrected, ran off the north side of the road, overcorrected again and flipped the car onto its side on the south side of the roadway.
48-year old Kenneth Eichholz, a passenger in the Chevy, was not wearing a seat belt and suffered fatal injuries.
6-year old Carlee Abbott of Westphalia, also a passenger, was belted in and suffered minor injuries.
Laux, the driver, suffered minor injuries and has been charged with involuntary manslaughter, second degree assault, DWI, endangering the welfare of a child, and careless and imprudent driving. She was taken to the Miller County Jail.
